Peatura APP 用户协议

本用户协议(以下简称“本协议”)由南京市行者无疆信息科技有限公司(以下简称“我们”“行者无疆”)与您(以下简称“用户”)共同签署。本协议旨在明确您使用Peatura APP(以下简称“本APP”)及配套智能项圈硬件(以下统称“本服务”)过程中的权利义务关系。

请您在使用本服务前,仔细阅读并充分理解本协议全部内容,尤其是涉及账号管理、用户义务、免责声明、知识产权的条款。您点击“同意”、完成账号注册或实际使用本服务,即视为您已接受本协议的全部约定,与我们建立服务合同关系。若您不同意本协议内容,请勿使用本服务。

一、服务内容

1.1 核心服务

我们为您提供以下核心服务:(1)本APP与智能项圈的绑定、蓝牙配对及2.4G WiFi网络配置;(2)宠物行为识别与数据采集、统计及展示(包括但不限于进食、喝水、运动、休息、声音等数据);(3)基于宠物行为及互动场景的拟猫话主动发声服务;(4)宠物每日行为时间轴、数据看板展示及历史数据查询;(5)账号管理、消息通知等基础服务。

1.2 服务调整

我们有权根据技术发展、业务需求及法律法规变化,对本服务的功能、内容进行升级、优化或调整,并通过APP弹窗、消息通知等方式向您公示。若服务调整涉及核心权益变更,我们将给予您合理的公示期,您可选择继续使用或终止服务;若您继续使用,视为接受调整后的服务。

1.3 服务限制

本服务仅适用于Peatura品牌配套智能项圈,您需确保硬件设备为正品且功能正常;本APP仅支持iOS、Android系统符合要求的移动设备,若您的设备版本过低,可能无法正常使用部分服务功能。

二、账号管理

2.1 账号注册与绑定

您需通过手机号码验证或第三方账号(如微信、苹果ID、Google账号等)授权注册本APP账号,注册时需提供真实、准确的信息。账号注册成功后,您可绑定1台或多台Peatura智能项圈,绑定后可对设备进行管理及数据查看。

2.2 账号使用与保管

您应对账号及密码的安全性负责,不得将账号转借、出租、赠与他人或交由他人保管、使用。因您自身原因导致账号泄露、被盗用所产生的一切损失,由您自行承担。若发现账号异常使用,您应立即修改密码并联系我们客服冻结账号。

2.3 账号注销

您可在本APP“我的”中申请注销账号,注销前请确保已解绑所有绑定的智能项圈。账号注销后,您将无法再使用该账号登录本服务,账号相关的个人信息及宠物数据将按《Peatura APP隐私协议》的约定进行删除或匿名化处理,注销后无法恢复。

三、用户义务

3.1 合规使用义务

您在使用本服务时,应遵守《中华人民共和国网络安全法》《中华人民共和国个人信息保护法》等法律法规及公序良俗,不得利用本服务从事任何违法违规活动,包括但不限于:(1)传播淫秽、暴力、恐怖、仇恨等违法或不良信息;(2)侵犯他人名誉权、隐私权、知识产权等合法权益;(3)恶意攻击、篡改本APP程序或智能项圈数据;(4)利用本服务从事欺诈、盗刷等违法活动。

3.2 设备及数据相关义务

您应妥善保管智能项圈,正确按照产品说明书进行使用、充电及维护,避免因使用不当导致设备损坏或数据丢失;您应确保授权我们收集、使用的宠物数据及个人信息真实、准确,若信息发生变更,应及时更新。

3.3 第三方服务义务

本服务可能包含第三方提供的服务(如第三方登录、支付等),您使用第三方服务时,需遵守第三方的服务条款及隐私政策,我们不对第三方服务的安全性、合法性承担责任。

四、知识产权

4.1 我们的知识产权

本APP的软件程序、界面设计、文字内容、图标、logo、数据算法及智能项圈的硬件设计、技术方案等均归我们或相关权利人所有,受《中华人民共和国著作权法》《中华人民共和国专利法》《中华人民共和国商标法》等法律法规保护。我们授予您在使用本服务期间的非独占、不可转让的使用权,您不得擅自复制、修改、分发、反向工程、拆解智能项圈或本APP程序。

用户的知识产权

您通过本服务上传、生成的宠物相关内容(如宠物照片、视频等)的知识产权归您所有,但您授予我们在提供本服务的范围内,免费、非独占的使用权(包括但不限于存储、展示、分析等),该授权不影响您对内容的合法权益。

五、数据使用与保护

我们对您的个人信息及宠物相关数据的收集、使用、存储、共享等行为,均严格遵守《Peatura APP隐私协议》的约定。您确认已阅读并理解《Peatura APP隐私协议》的全部内容,同意我们按该协议处理相关数据。

六、免责声明

6.1 服务可用性免责

我们将尽力保障本服务的稳定运行,但因网络故障、服务器维护、不可抗力(如地震、台风、政策调整等)、第三方服务异常等原因导致本服务暂时无法使用或数据传输中断的,我们不承担赔偿责任,将在合理时间内恢复服务并及时通知您。

6.2 数据及设备免责

本服务提供的宠物行为数据、健康状态初步监测仅为参考,不构成医疗诊断建议,若您的宠物出现健康问题,应及时咨询专业兽医;因您操作不当、设备故障、意外损坏等导致的智能项圈无法使用或数据丢失,我们不承担责任,可提供合理的技术支持。

6.3 第三方行为免责

任何因第三方非法入侵、数据窃取、传播不良信息等行为导致的损失,由第三方承担责任,我们不承担赔偿责任,但将积极配合您维权。

七、协议的变更、解除与终止

7.1 协议变更

因法律法规更新、业务调整等原因,我们可能修改本协议内容,修改后的协议将通过APP弹窗、消息通知等方式公示,公示期不少于7天,公示期满后生效。若您对修改后的协议有异议,可停止使用本服务;若您继续使用,视为接受修改后的协议。

7.2 协议解除与终止

您可随时停止使用本服务,单方解除本协议;若您违反本协议约定,我们有权暂停或终止向您提供本服务,注销您的账号,并追究您的相关责任;服务终止后,本协议中关于知识产权、免责声明、争议解决等具有持续性的条款仍然有效。

八、争议解决

本协议的签订、履行及解释均适用中华人民共和国法律(不包括冲突法规则)。若您与我们就本协议的履行发生争议,应首先通过友好协商解决;协商不成的,任何一方均有权向南京市雨花台区人民法院提起诉讼(公司住所地法院)。

This User Agreement (hereinafter referred to as the "Agreement") is entered into between Nanjing Walk Without Boundaries Information Technology Co., Ltd. (hereinafter referred to as "we" or "Walk Without Boundaries") and you (hereinafter referred to as the "User"). This Agreement aims to clarify the rights and obligations of both parties during your use of Peatura APP (hereinafter referred to as the "APP") and its supporting smart collar hardware (collectively referred to as the "Services").

Please carefully read and fully understand all the contents of this Agreement before using the Services, especially the clauses related to account management, user obligations, disclaimers, and intellectual property rights. By clicking "Agree", completing account registration, or actually using the Services, you are deemed to have accepted all the terms of this Agreement and entered into a service contract with us. If you do not agree to the contents of this Agreement, please do not use the Services.

I. Service Content

1.1 Core Services

We provide you with the following core services:

(1) Binding, Bluetooth pairing, and 2.4G WiFi network configuration between the APP and the smart collar;

(2) Collection, statistics, and display of pet behavior recognition and data (including but not limited to data on eating, drinking, exercise, rest, sounds, etc.);

(3) Cat-like active voice service based on pet behavior and interaction scenarios;

(4) Display of pet's daily behavior timeline and data dashboard, as well as historical data query;

(5) Basic services such as account management and message notifications.

1.2 Service Adjustments

We reserve the right to upgrade, optimize, or adjust the functions and contents of the Services in accordance with technological development, business needs, and changes in laws and regulations. We will notify you of such adjustments through APP pop-ups, message notifications, or other means. If the service adjustment involves changes to core rights and interests, we will give you a reasonable notice period, during which you may choose to continue using or terminate the Services. Your continued use shall be deemed as acceptance of the adjusted Services.

1.3 Service Restrictions

The Services are only applicable to the supporting smart collars of the Peatura brand. You shall ensure that the hardware device is genuine and functions properly. The APP only supports mobile devices running iOS or Android systems that meet the requirements. If your device version is too low, you may not be able to use some service functions normally.

II. Account Management

2.1 Account Registration and Binding

You need to register an APP account through mobile phone number verification or authorization of third-party accounts (such as WeChat, Apple ID, Google Account, etc.), and shall provide true and accurate information during registration. After successful account registration, you can bind one or more Peatura smart collars, and manage the devices and view data after binding.

2.2 Account Use and Safekeeping

You shall be responsible for the security of your account and password. You shall not lend, rent, gift your account to others, or entrust others to keep or use it. All losses arising from account disclosure or theft due to your own reasons shall be borne by you. If you find any abnormal use of your account, you shall immediately change your password and contact our customer service to freeze the account.

2.3 Account Cancellation

You can apply for account cancellation in the "My" section of the APP. Before cancellation, please ensure that all bound smart collars have been unbound. After account cancellation, you will no longer be able to log in to the Services with the account. The personal information and pet data related to the account will be deleted or anonymized in accordance with the provisions of the Peatura APP Privacy Policy, and cannot be recovered after cancellation.

III. User Obligations

3.1 Compliance Obligations

When using the Services, you shall comply with the Cybersecurity Law of the People's Republic of ChinaPersonal Information Protection Law of the People's Republic of China and other relevant laws and regulations, as well as public order and good customs. You shall not use the Services to engage in any illegal or irregular activities, including but not limited to:

(1) Disseminating obscene, violent, terrorist, hateful or other illegal or inappropriate information;

(2) Infringing upon the legitimate rights and interests of others such as reputation rights, privacy rights, and intellectual property rights;

(3) Maliciously attacking or tampering with the APP program or smart collar data;

(4) Using the Services to engage in fraud, unauthorized fund deduction, or other illegal activities.

3.2 Device and Data-related Obligations

You shall properly keep the smart collar, use, charge and maintain it in accordance with the product manual to avoid device damage or data loss caused by improper use. You shall ensure that the pet data and personal information authorized to be collected and used by us are true and accurate, and update such information in a timely manner if there are any changes.

3.3 Third-party Service Obligations

The Services may include services provided by third parties (such as third-party login, payment, etc.). When using third-party services, you shall comply with the service terms and privacy policies of such third parties. We shall not be liable for the security or legality of third-party services.

IV. Intellectual Property Rights

4.1 Our Intellectual Property Rights

The software programs, interface designs, text content, icons, logos, data algorithms of the APP, as well as the hardware designs and technical solutions of the smart collar are owned by us or relevant right holders, and are protected by the Copyright Law of the People's Republic of ChinaPatent Law of the People's Republic of ChinaTrademark Law of the People's Republic of China and other relevant laws and regulations. We grant you a non-exclusive and non-transferable right to use the Services during your use thereof. You shall not arbitrarily copy, modify, distribute, reverse engineer, or disassemble the smart collar or the APP program.

4.2 User's Intellectual Property Rights

The intellectual property rights of pet-related content uploaded or generated by you through the Services (such as pet photos, videos, etc.) are owned by you. However, you grant us a free and non-exclusive right to use such content within the scope of providing the Services (including but not limited to storage, display, analysis, etc.). This authorization shall not affect your legitimate rights and interests in the content.

V. Data Use and Protection

Our collection, use, storage, sharing and other behaviors regarding your personal information and pet-related data shall strictly comply with the provisions of the Peatura APP Privacy Policy. You confirm that you have read and understood all the contents of the Peatura APP Privacy Policy and agree to our processing of relevant data in accordance with the Policy.

VI. Disclaimer

6.1 Disclaimer for Service Availability

We will make every effort to ensure the stable operation of the Services. However, we shall not be liable for any temporary unavailability of the Services or data transmission interruption caused by network failures, server maintenance, force majeure (such as earthquakes, typhoons, policy adjustments, etc.), or abnormal third-party services. We will restore the Services within a reasonable time and notify you in a timely manner.

6.2 Disclaimer for Data and Devices

The pet behavior data and preliminary pet health status monitoring provided by the Services are for reference only and do not constitute medical diagnosis advice. If your pet has health problems, you shall consult a professional veterinarian in a timely manner. We shall not be liable for the inability to use the smart collar or data loss caused by your improper operation, device malfunction, accidental damage, etc., but can provide reasonable technical support.

6.3 Disclaimer for Third-party Behaviors

Any losses caused by illegal intrusion, data theft, dissemination of inappropriate information or other behaviors of third parties shall be borne by such third parties. We shall not be liable for compensation, but will actively cooperate with you in safeguarding your rights.

VII. Modification, Termination and Cancellation of the Agreement

7.1 Modification of the Agreement

Due to updates in laws and regulations, business adjustments or other reasons, we may modify the contents of this Agreement. The modified Agreement will be announced through APP pop-ups, message notifications or other means, with a notice period of no less than 7 days, and will take effect after the notice period expires. If you have any objection to the modified Agreement, you may stop using the Services; your continued use shall be deemed as acceptance of the modified Agreement.

7.2 Termination and Cancellation of the Agreement

You may stop using the Services at any time and unilaterally terminate this Agreement. If you violate the terms of this Agreement, we reserve the right to suspend or terminate the provision of Services to you, cancel your account, and pursue your relevant liabilities. After the termination of the Services, the clauses of this Agreement with continuous validity, such as those related to intellectual property rights, disclaimers and dispute resolution, shall remain in effect.

VIII. Dispute Resolution

The conclusion, performance and interpretation of this Agreement shall be governed by the laws of the People's Republic of China (excluding conflict of laws rules). If any dispute arises between you and us in connection with the performance of this Agreement, the parties shall first seek to resolve it through friendly negotiation. If the negotiation fails, either party shall have the right to file a lawsuit with the People's Court of Yuhuatai District, Nanjing City (the court of the company's domicile).
